In last night’s BK Live, I discussed the hung jury in the trial of Baltimore PD’s Officer William Porter. For weeks, many news reports have stated that the prosecution chose to try Porter first because he’s a “material witness” for two other officers whose trials are coming up in early 2016. I’ve been scratching my head since first reading that statement, wondering how they planned to use Porter or his statements in subsequent trials because the US Supreme Court has said that a co-defendant’s statements cannot be used against the other defendants. (However, if Porter cut a deal which included testifying against the others, that would be permissible.)
